The Texas Department of Insurance, Division of Workers’ Compensation (TDI-DWC) is accepting public comment on the proposed amendments to 28 Texas
Administrative Code (TAC) §§180.1, 180.3, 180.5, and 180.27 and proposed new rules 28 TAC §§180.4, 180.9, and 180.10.  This proposal relates to monitoring and
enforcement activities conducted by the TDI-DWC, specifically compliance audits, on-site visits, proposals for decision, informal dispositions by default, and ex parte
emergency cease and desist orders.  These proposed amendments and new rules are primarily intended to implement recent statutory amendments in House Bill 2605 by the
82nd Legislature, Regular Session, effective September 1, 2011, that affect the TDI-DWC’s monitoring and enforcement authority.

The proposal was published in the September 23, 2011, issue of the Texas Register and may be viewed on the Secretary of State website at http://www.sos.state.tx.
us/texreg/index.shtml.  A courtesy copy of the proposal is also available on the TDI website at http://www.tdi.texas.gov/wc/rules/proposedrules/index.html.  The public
comment period on the proposal closes Monday, October 24, 2011 at 5 p.m. Central Standard Time (CST).  Comments received after the close of comment will not be
considered.

A public hearing on this proposal will be held on October 17, 2011 at 1:30 p.m. CST in the Tippy Foster Room of the TDI-DWC Central Office, 7551 Metro Center Drive,
Suite 100 in Austin, Texas.  The TDI-DWC provides reasonable accommodations for persons attending meetings, hearings, or educational events, as required by the

prior to the confirmed hearing date.
